ABOUT THE BOOK
Beyond Identity: Emerging Frontiers of Personality Rights and Law is an edited volume that seeks to critically examine the evolving nature, scope, and significance of personality rights in an increasingly digital, interconnected, and technology-driven society. Traditionally associated with the protection of an individual’s name, image, likeness, voice, reputation, privacy, and other identifiable attributes, personality rights have increasingly expanded beyond conventional notions of identity. The rapid development of social media, artificial intelligence, digital platforms, virtual environments, biometric technologies, deepfakes, voice cloning, and data-driven technologies has created new dimensions of identity that challenge existing legal frameworks and traditional understandings of individual autonomy and dignity.
The contemporary digital environment has transformed the manner in which individuals construct, communicate, commercialise, and control their identities. Personal identity can now exist across multiple digital platforms, including social networking accounts, digital avatars, virtual influencers, gaming environments, and AI-generated representations. At the same time, technological tools enable the unauthorised reproduction, manipulation, and commercial exploitation of a person’s face, voice, name, image, likeness, and other distinctive characteristics. These developments raise significant legal questions concerning consent, ownership, control, privacy, dignity, reputation, commercial appropriation, and the remedies available to individuals whose identities are misused.
The book aims to explore the intersection of personality rights with constitutional law, privacy law, intellectual property law, data protection, media law, technology law, artificial intelligence, and emerging digital technologies. It seeks to analyse how existing legal principles can respond to contemporary forms of identity exploitation while also identifying gaps and limitations within existing regulatory frameworks. Particular attention may be given to the increasing commercial value of personality and the legal challenges arising when an individual’s identity becomes a valuable economic asset capable of licensing, merchandising, endorsement, and digital exploitation.
